This Website (“Website”) and the REVOLUTION RIDE ("REVOLUTION", "RR", "we", "us", or "our") App(s) (“App(s)”) is operated by REVOLUTION. Please take the time to read these Terms and Conditions (“Terms”) carefully, as they contain important information regarding your legal rights, remedies and obligations.
These Terms with our Privacy Policy sets forth the legally binding Terms and Conditions for your use of the Website, our mobile App(s), and other Services that we provide, including all Services provided at our studio (the “Services”). Accessing or using the Services in any manner, including, but not limited to, browsing the Website, downloading the mobile App(s), adding content, sharing feedback or other materials to the Website or on or via the mobile App(s), you agree to the Terms and are therefore bound by them. You are only permitted to use the Services if you agree to abide by all applicable laws and to the Terms. If you do not agree, please leave the Website and/or mobile App(s) and discontinue any use of our Services.
REVOLUTION reserves the right to modify the Terms at any time, in our sole discretion. Should we modify material terms to this agreement, notice will be sent to you. The manner of notification may include email, posted notice on the Website or mobile App(s) or any other manner. Modification will be effective after we send you notice of the amended agreement. failure to cease use of our Services after receiving notification of the modification, will constitute your agreement of the modified terms.
By using the Services, you confirm that you are over 16 years of age, and, if between the ages of 16 and 18, your parent or guardian has consented to the Terms.
INTELLECTUAL PROPERTY.
All the content on the Website and App(s) including without limitation, the text, graphics, photos, sounds, videos & music (“Content”) and the trademarks and logos contained therein (“Logo”), are owned by or licensed to REVOLUTION, subject to copyright and other intellectual property rights under the law. The content on the Website and App(s) is provided to you, and only for your personal use, the content may not be downloaded, copied, sold, or otherwise exploited for any other purposes without RR consent. You agree to not engage in the use of coping and selling of any of the Contents on this Website.
BOOKINGS, PAYMENTS & GIFTCARDS.
After creating an account, you will have a have to buy a package in order to make a reservation, to buy an individual class or a package please click here. You are able to book 1 bike per class and unlimited classes per week. RR reserves the right to hold up to ten (10) spots in each class.
Classes expire. The expiration dates are posted in the description of the class or packages on the Website and the App(s) If, however, something unexpected happens and you are not able to ride for an extended period of time, just give us a call and we will help you out.
You can book your classes online up to 1 week in advance. The class schedule will open every Sunday at noon all the way through the following Sunday.
RR reserves the rights to change class prices, but we will honor your class or packages until the expiration date.
At REVOLUTION we accept MasterCard, Visa and Cash payments.
Gift cards never expire and can be used for classes, F&B and merchandise. Once a class is purchased using a gift card, it will expire, just like any other class you buy.
Classes are not transferrable, when you buy a class, you only are entitled to use the class. You cannot redeem your class for cash.
WAITLIST
A class that is fully booked will be marked as WAITLIST on the class schedule. You can put your names on the waitlist in case a spot opens up. When a spot opens up, we will fill the spot with clients that have placed their name on the waitlist.
CANCELATION POLICY FOR CLASS BOOKINGS.
You have the right to cancel your booked classes. Our cancelation policy states that classes can be canceled free of charge 6 hours prior to class starting time. When a reservation is cancelled within the 6 hours, the class will be returned as a credit into to your account and can be used for a future ride.
Classes cannot be canceled less then 6 hours prior to the class starting time. If you are unable to join the class but cannot cancel 4 hours prior please call the studio, if we find a replacement for your booking your class may be recredited.
Please be informed. BIKES AND SPOTS WILL BE RELEASED 5 MINUTES PRIOR TO THE CLASS STARTING TIME. Please arrive 5 minutes prior to the class starting time to claim your bike, if you are running late please call the studio. If you are not present 5 minutes prior to class starting time RR reserved the right to without recrediting you, to resell your bike against a fee to a waitlisted client.
If you are running late, we cannot guarantee that the bike you initially reserved is still available. Clients who are more then 10 minutes late will not be allowed into the bike room as its to disturbing for the other riders.
REFUND POLICY
Classes, packages & are non-refundable.
We do not offer refunds on purchases, make sure you want to commit to buying large class packages as classes are non-refundable and not transferrable.
Unused merchandise can be exchanged or refunded within 14 days of purchase. No exchange or refund will be provided without a receipt.
RR guarantees a full refund on merchandise, provided that all goods are returned in the same condition in which you received them. This means that the goods should not be damaged, washed, soiled, worn (except for testing) or modified, and all labels or tags should be intact.
The packaging is not the subject of the purchase or part of the purchased item. Nevertheless, RR is entitled to reimbursement of the costs actually incurred in connection with the return of the goods. These costs are always assessed individually and as such are then charged to the customer and set off against the amount of returned goods.
For hygienic and safety reasons, the right to return do not apply to face masks.
TERMINATION
RR reserves the right to terminate your access to the Services at any time, in our sole discretion, without cause or notice.
Causes for immediate termination of services: Clients who are under the influence of alcohol or drugs, bring weapons or toxic substances into the studio, use uncivilized terms and offensive language towards other clients and/or team members, who portrait abusive and violent behavior.
If you breach the Terms, we terminate your account and you will not be entitled to a refund for any unused classes and credits.
You may terminate your account at any time, for any reason. This can be done on your account on the Website or by email.
PERSONAL BELONGINGS
You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings. We do not recommend bringing large amounts of cash or valuable items into the studio. RR is not responsible for any damages and loss.
Lockers are available to our client’s subject to availability. All lockers must be cleared after your visit, no items must be kept overnight. Any un-claimed belongings will be taken from the lockers at closing time and kept in lost and found for 14 days before being disposed of.
LIMITATION OF LIABILITY
We encourage you to consult with your doctor and consider the associated risks before participating in any of our classes at the studio. You hereby agree and warrant that you are fit to participate in our classes and have voluntarily chosen to sign up and participate our high intensity classes.
You acknowledge that you are responsible for monitoring your own physical condition. You confirm to have given us all the necessary information regarding your health this includes but is not limited to heart conditions, dizziness, chest pain, loss of balance, back problems, previous knee injuries, bone or joint injuries.
We make use of light equipment in our classes that create flashing or flickering lights which may cause discomfort and trigger seizures for clients with for example photosensitive epilepsy.
In no event shall REVOLUTION and its team members be liable to you or any third party for any direct or indirect incidental, punitive, errors of any kind in email communication, pricing on the Websites/ App(s) etc.
Pandemics, emergencies and service interruptions
REVOLUTION RIDE’s Services may be suspended temporarily or permanently without notifying you for security and safety purposes, maintenance, system failures, or other similar circumstances. You are aware and agree to, that you are not entitled to a refund for a period of 6 months when such interruptions occur.
DISCLAIMERS
REVOLUTION RIDE, and team members disclaim all warranties, in connection with the RR Services, the Website, the App(s) and your use thereof. We do not claim that the RR Services will meet your expectations, and we cannot guarantee any specific results from the use of our Services. You expressly agree that use of the RR Services is at your sole choice and that the entire risk as to satisfactory quality & performance is with you.
WAIVER
By signing up for and/or attending classes or any activities using the RR studio you acknowledge and agree that there are certain risks and dangers in indoor cycling. You acknowledge that some of the potential risks cannot be avoided regardless of the care taken to avoid injuries. You are aware that the risks vary from one activity to another but range from (l) minor injuries such as, bruises and sprains to (ll) major injuries such as joint or back injuries, loss of sight & heart attacks, to (lll) catastrophic injuries including broken bones, paralysis and death. You understand the full risks and will not hold RR liable for any injuries.
